The California Foreclosure Reduction Act. By - Bay Area Real Estate ...

What?????????????????? The California Foreclosure Reduction Act (aka Homeowner?s Bill of Rights) amends California?s non-judicial foreclosure process.

When? ??????????????? Goes into effect Jan. 1, 2013, in effect 5 years.

Who???????????????????? Affects borrowers, loan servicers, lenders and DRE licensees.? ?Smaller banks? are exempt.? Applies to 1st position loans against residential 1-4 unit owner-occupied dwellings.

Why???????????????????? Designed to solve the problems with borrowers experiencing ?dual tracking,? lack of responsiveness from lenders loan modifications and the perceived problem with ?robo-signing.?

How???????????????????? Prohibits lenders from foreclosing if the borrower is in an trial loan mod or if the lender has not yet responded to the borrower?s application.? Lenders must cancel a foreclosure sale if the short sale has been approved, and proof of funds has been given to lender.? Borrowers can seek an injunction to stop the foreclosure if lenders don?t comply, and win attorney?s fees and costs and damages up to $50k.

The New Law:

  1. Changes Loan Modifications
    1. Prior state of the law was that they must consider the app. Now, they must respond within 5 days
    2. Borrower has 30 days to appeal denial
    3. No Notice of Trustee?s Sale or trustee?s sale may be held if application is pending
    4. Prohibits creditors from recording a notice of default when a timely-filed application for a loan modification or other loss mitigation measure is pending.
    5. Prohibits creditors from recording a notice of sale while a borrower is in compliance with the terms of a trial loan modification or after another loss mitigation measure has been approved.
    6. Require creditors to disclose why an application for a loan modification or other loss mitigation measure has been denied.
  1. Deals with Short Sales
    1. Lender must cancel a sale if the short sale has been approved by all lienholders, and proof of funds has been given to lender.
  1. Imposes Tougher pre-foreclosure Requirements on the Lender:
    1. Pre-Notice of Default (NOD) requirements ? must give the borrower a notice re: right to get docs
    2. Requires creditors to provide documentation to a borrower that establishes the creditor?s right to foreclose on real property prior to recording a notice of default.
  1. Gives Borrowers a Stronger Legal Remedy
    1. Statute gives borrowers a private right of action, and they can seek an injunction to stop the foreclosure sale if lenders violate the provisions.
    2. Statute provides for attorney?s fees and costs, damages up to $50k.
    3. Affects DRE licensees because if a licensee violates the provisions, it is a violation of their license.
  1. Makes communication of the sale date mandatory.
    1. Requires that notices of foreclosure sales be personally served, including notices of foreclosure sale postponement (if postponement is 10 days or more).

(AP) ? Poisoned-tipped arrows and jewelry made of ostrich egg beads found in South Africa show modern culture may have emerged about 30,000 years earlier in the area than previously thought, according to two articles published on Monday.

The findings published in the journal "Proceedings of the National Academy of Sciences" show that the 44,000-year-old artifacts are characteristic of the San hunter-gatherers. The descendants of San people live today in southern Africa, so the items can clearly be traced forward to modern culture, unlike other archaeological finds, researchers said.

South African researcher Lucinda Backwell said the findings are the earliest known instances of "modern behavior as we know it." Backwell said the discovery reinforces the theory that modern man came from southern Africa.

The carbon dating on the items shows that traces of the San culture may have existed earlier than the previous estimate of somewhere between 10,000 and 20,000 years ago, the journal said.

The find, discovered at Border Cave close to South Africa's northeastern border with Swaziland, is a comprehensive package of hunting kits and jewelry made of ostrich egg and marine shell beads.

Backwell, who was part of the team of international researchers that made the find, said the artifacts created as many as 44,000 years ago served the same purposes as they would today.

"They all have a specific reason we understand, that's why we can name them," Backwell said.

The researchers' articles said the Border Cave people used poisoned arrows to hunt and put spiral engraving on arrowheads to indicate ownership. The latter practice has been preserved in the San culture, they said.

Professor Francesco d'Errico of the French National Research Centre, who led the research team, said that the findings tell of a people who were highly evolved.

"They were fully modern genetically and cognitively," d'Errico said.

Their cognitive development is evident in their symbolic behavior, the professor said. The ostrich egg beads were not only ornaments, but played a major role in bartering with neighboring groups, he said. That practice continues today.

The paper claimed that the fossils show that all modern culture came from southern Africa, though the researchers acknowledged it remains difficult to pinpoint where in history that modernity began.

Eric Delson, a paleoanthropologist at Lehman College of the City University of New York, said that while the testing used by the researchers to determine the age of the fossils was very clear and reliable, the findings didn't support the idea that all modern human cultures are connected to this find.

He said there is evidence that a modern culture already existed in Europe around the time the new find is dated.

"They say, 'Modern human behavior first found!'" Delson said. "Well, not exactly."

He did, however, applaud the research for finding the origins of one specific group of modern people.

Scientists from Britain, France, Italy, Norway, South Africa and the U.S. all took part in the research, helmed out of the University of Witwatersrand in Johannesburg.

Wallenda fires back at N. Falls mayor

NIAGARA FALLS, N.Y. (WIVB) - Daredevil Nik Wallenda is firing back at the mayor of Niagara Falls over a money squabble.

Mayor Paul Dyster claims Wallenda owes the city $25,000 in security costs, which the tightrope walker says he has already settled with the state.

The city council agreed with Wallenda, passing a resolution last week directing Dyster to stop his efforts to collect that money.

Wallenda says the mayor still claims he needs to pay up.

So the daredevil issued a statement overnight reading in part, "My contract was with New York State...Because there is not a contract with the city of Niagara Falls, there is no bill. To suggest otherwise is a blatant misrepresentation...I have fulfilled my contractual obligations to the fullest extent, and have magnificent memories of my time in Niagara Falls."

Staten Islanders urged to sign up for cancer prevention study ...

STATEN ISLAND, N.Y. -- Most people would find a cancer diagnosis to be an adverse event, something negative that overshadows the positive in one?s life. Not Cathy R. Williams.

When the Stapleton resident was diagnosed with breast cancer in 2001, it gave her a higher purpose. Even through chemotherapy, multiple surgeries and a mastectomy, she knew that with cancer came her calling.

Active with the American Cancer Society ever since, she now is a Community Champion for the Cancer Prevention Study-3 (CPS-3), a nationwide initiative of the cancer-fighting organization that aims to identify factors that play a role in the disease.

?It?s a continuous journey for me,? said Mrs. Williams of the time she spends educating people about cancer. ?I?m always looking to hone my skills and the CPS-3 comes at just the right time for me.?

Organizers of the study aim to recruit 300,000 people of diverse backgrounds nationwide, with at least 1,000 from the Island. Participants ? who must be between the ages of 30 and 65 and never have been diagnosed with cancer ? can register to participate by visiting cancer.org/cps3statenisland.

An in-person portion of the study will take place Sept. 12-15 at designated partner sites. Participants will undergo a brief written survey and provide physical measurements and a small blood sample.

They then must complete an at-home survey that asks about lifestyle, behavioral and other factors related to their health. Once finished, participants receive follow-up surveys in the mail every two years for at least 20 years.

After Mrs. Williams was diagnosed with cancer, she made a vow to God that if He brought her through this trying time, she would do everything in her power to help others avoid the devastating diagnosis.

She became involved with the Making Strides Against Breast Cancer walk, Relay For Life and the Reach to Recovery program, which pairs breast cancer survivors with newly-diagnosed patients.

When the chance to help with CPS-3 arrived, Mrs. Williams didn?t hesitate. She began recruiting people right after the kick-off last month at Borough Hall. On her mile-and-a-half walk home, she handed out study fliers to anyone who would listen.

?I wanted something that was ongoing and when CPS-3 came up, I said this is my prayer answered,? said Mrs. Williams, whose husband also is a cancer survivor. ?I wanted a way to communicate with everyone the importance of cancer awareness.?

Additionally, she is working to recruit family members and friends, like Tanya Michelle Debose, a member of Mrs. Williams? church. Although Ms. Debose doesn?t have any immediate family members with the disease, she knows others who have witnessed cancer?s effects and quickly signed up.

?I think the only way to get down to a problem is to study it,? said Ms. Debose, a Coram, N.Y., resident. ?If I knew I had it in my power to help someone else from going through this pain, then why wouldn?t I do it??

The new study comes on the heels of three previous studies. The Hammond-Horn Study, conducted in the1950s, was among the first to link cigarette smoking to lung cancer deaths in men, explained Dr. Susan Gapstur, vice president of Epidemiology for the American Cancer Society.

Cancer Prevention Study-I ran from 1959 to 1972. This larger-scale study included women and taught researchers more about smoking and cancer risk. It also linked obesity to overall, as well as cancer deaths.

Cancer Prevention Study-II began in the 1980s and is ongoing. Building on the findings of the previous two, it has shown the role of low-tar cigarettes in lung cancer and helped clarify the role of obesity in more than 10 cancer sites throughout the body, among other findings.

With an ever-changing community, CPS-3 is expected to build on its predecessors.

?The fight needs to continue,? Dr. Gapstur said. ?We need to better understand what happens in a society when we are living with being overweight and obese much longer. We need to track the relation to cancer.?

Additionally, the new study will allow researchers to identify whether other factors might affect cancer. For example, data is being collected so researchers can better understand whether certain medications might reduce or increase risk for the disease. With the blood sample, researchers can take a deeper look into how some biologic factors are linked to cancer risk.

Enrollment for CPS-3 began in 2006, and initially was done at Relay For Life events. To get to their goal of 300,000 participants by December 2013 ? more than 137,000 already have signed up ? the American Cancer Society began working with community partners around the country.

Although the findings from CPS-3 may not effect the current population, it potentially can have a profound impact for future generations, with the goal of one day finding a cancer cure.

?Despite the progress that has been made at reducing cancer mortality rates, the fight against cancer has to continue and we just can?t stop,? Dr. Gapstur concluded. ?It?s important to continue with studies like CPS-3 so we can improve the health of the next generation.?

Lotus leaf inspires fog-free finish for transparent surfaces

ScienceDaily (July 30, 2012) ? Inspired by the water-repellent properties of the lotus leaf, a group of scientists in China has discovered a way to impart a fog-free, self-cleaning finish to glass and other transparent materials. "Superhydrophobic" surfaces, such as the lotus leaf, are excellent at repelling water and also boast other "smart" self-cleaning, anti-glare, anti-icing, and anti-corrosion properties.

By using hollow silica nanoparticles that resemble raspberries, scientists at the Chinese Academy of Sciences were able to apply a clear, slick, water-repellent surface to glass.

This is significant in material fields because it means that after modifying low-surface-energy materials and creating surface textures on them, surfaces can be made to exhibit completely different wetting characteristics -- either repelling or attracting moisture.

As described by the scientists in the American Institute of Physics (AIP) journal Applied Physics Letters, these surfaces show good anti-fogging and light transmittance properties before and after chemical modification, which should help pave the way to a clearer, fog-free performance for windshields, windows, solar cells and panels, LEDs, and even TVs, tablets, and cell phone screens.

Smart surface coatings are highly desirable, especially for solar cells and panels, which frequently lose up to 40 percent of their efficiency to dust and dirt buildup within a year of installation. The next challenge the scientists face is figuring out how to move the smart surfaces from the lab to industry in a cost-efficient manner.
