Government Can Raise 'Untimeliness' - Legal Blog Network - FindLaw

The government is entitled to a little latitude when asserting the untimeliness of an appeal, according to a recent Third Circuit decision.

Abdul Kariem Muhammud pleaded guilty to conspiracy to distribute controlled substances, possession of a firearm in furtherance of a drug trafficking crime, and possession of a firearm by a convicted felon pursuant to a written plea agreement in which he waived his right to appeal or collaterally attack the judgment of conviction.

More than two years after he was sentenced, Muhammud filed a notice of appeal asserting ineffective counsel.

The government, mistakenly believing that he was appealing the denial of his habeas petition, moved to enforce the waiver but failed to assert the untimeliness of what was an appeal from the judgment of conviction. So can the government initially raise untimeliness in its merits brief to an appellate court? The Third Circuit Court of Appeals says it can.

The time limit for filing a criminal appeal set forth in Rule 4(b) is rigid but not jurisdictional, and may be waived if not invoked by the government. An untimely appeal must be dismissed if the government objects.

Before this case, the Third Circuit had not considered whether the government could object to timeliness at any point up to, and including in, its merits brief. The Eighth, Tenth, Eleventh, and D.C. Circuits, however, all agreed that it was an acceptable practice.

While the Third Circuit joined the other circuits in permitting the government to initially raise untimeliness in its merits brief, it strongly encouraged the government to file a motion to dismiss a criminal appeal as untimely at the outset of an appeal in the future.

The news sure isn't what it used to be, in fact, I am even amazed at some of the stuff that I hear on the TV Financial news, as commentators give it their best guess on potential solutions to solve the economic crisis. All these notions about too big to fail, nationalizing banks and having the government decide who gets paid how much is just a lot of hot air.

Indeed, I feel embarrassed for some of the news reporters as they misspeak on issues surrounding capitalism. You know, maybe we ought to tell our news reporters that they cannot comment on business matters unless they had once run a business? I mean anyone can get a nice haircut, nice suit and smile for the camera with a little make-up and a complete make-over. Heck, why is it that anyone who can read a teleprompter is assumed to know what he's talking about, come on already.

We live in the most powerful and greatest nation on Earth, it is by far and away the most awesome country ever created in human history. Why you ask? Simple, one word actually, it's called; Capitalism. And it's just amazing that no one gets it. Maybe a re-read of Ayn Rand's Atlas Shrugged is in order for all those news commentators and newspaper reporters who love to take a jab or make a persnickety comment in their otherwise shallow news stories.

And why is it that the editors of these TV News programs, newspapers and radio segments allow this nonsense to be played on the air, why It's pure opinion and it's not based on anything. Socialism doesn't work, communism is a dead end (literally) and we've proven capitalism pushes people, society and civilization up. Next time you hear someone on TV or read an article in the newspaper trashing capitalism, consider the source. There is someone who has never once had to make a payroll.

Watch the Webcast of the 2012 Rosalynn Carter Symposium on Mental Health PolicyTomorrow I head down to Atlanta to attend the 28th Annual Rosalynn Carter Symposium on Mental Health Policy at The Carter Center. This year?s meeting will bring together more than 200 mental health leaders, stakeholders, and providers to discuss moving beyond stigma and prejudice, and how we can take steps to build social inclusion of people living with mental illnesses.

While it?s a closed event, they do a live webcast of the event throughout the day, allowing anyone to gain from its presentations.

The stigma and prejudice surrounding mental diagnoses and mental health care remain a huge issue in the U.S. and throughout the world. In the U.S. alone, it?s estimated to cost over $300 billion because of untreated mental illness.

The Carter Center?s Mental Health Program works tirelessly to try and reverse this trend.

Former U.S. First Lady and Carter Center Co-Founder Rosalynn Carter organizes the event each year to bring together many mental health policy leaders, stakeholders, and advocates. This is the 28th year for the meeting.

?Although we know much more about mental illnesses and how to treat them than ever before, stigma against these disorders remains,? said Mrs. Carter.

?One of the best ways to fight stigma and discrimination in the long run is to take action and develop public policies that provide communities with the foundations and tools to include and support people living with mental illnesses. We hope this year?s symposium will give many communities throughout the country the information they need to support all of their citizens and help improve life for everyone.?

We?ll be providing a summary of the meeting over the weekend.

Police: Hackman admits slapping homeless man

Oscar winner Gene Hackman admitted to slapping a homeless man across the face Tuesday afternoon, saying the guy approached him and his wife, Betsy, in a menacing manner and called Betsy a derogatory name, Santa Fe, N.M., police confirm to E! News.

Sgt. Andrea Dobyns told E! that the man on the receiving end of the slap called authorities at around 1:30 p.m. to report that he had been beaten up by Hackman.?

Mitt Romney's choice to play him in a movie? Gene Hackman!?

Officers who responded were able to talk to both the caller and Hackman, who was still in the area after eating at a nearby restaurant.?

The "Unforgiven" star told police that the man approached him and Betsy in a very aggressive manner, called his wife a nasty name?and otherwise made them fear for their safety.?

The man got into his face, according to Hackman, and he hit him, "more like a slap than a punch," Dobyns said.?

Hackman seems to have recovered his strength since being hit by a car while riding his bike?

The guy had no visible injuries and no one was arrested or cited for the altercation.?

Sleep duration affects hunger differently in men and women

ScienceDaily (Oct. 31, 2012) ? A new study suggests that increasing the amount of sleep that adults get could lead to reduced food intake, but the hormonal process differs between men and women.

"Restricting sleep in healthy, normal weight participants has limited effects on metabolic risk factors and may affect food intake regulating hormones differently in men and women," said Marie-Pierre St-Onge, PhD, FAHA, the study's principal investigator. "We were surprised by the lack of a significant effect of sleep on glucose and insulin, leptin, and sex differences in the hunger-stimulating hormone ghrelin and the satiety hormone GLP-1."

The study, appearing in the November issue of the journal SLEEP, tracked the sleep duration, glucose dysregulation, and hormonal regulation of appetite in 27 normal weight, 30- to 45-year-old men and women. Participants provided fasting blood draws, and they were studied under two sleep conditions: Short (4 hours) or habitual (9 hours). Short sleep increased total ghrelin levels in men but not women and reduced GLP-1 levels in women but not in men, a sex difference that has not been reported before. The results suggest that the common susceptibility to overeat during short sleep is related to increased appetite in men and reduced feelings of fullness in women.

"Our results point to the complexity of the relationship between sleep duration and energy balance regulation," St-Onge said. "The state of energy balance, whether someone is in a period of weight loss or weight gain, may be critical in the metabolic and hormonal responses to sleep restriction."

According to the authors, this is the largest controlled clinical investigation of the effects of sleep reduction on hormonal regulation of food intake. The results support a causal role of sleep duration on energy intake and weight control.

I think the main reason no one knows how to sew a button is that they don't NEED to, generally speaking. Mass-produced clothing isn't the same quality it used to be; it's cheaply made, rarely has buttons (when was the last time you saw someone under 40 wearing a buttoned shirt or dress?) and by the time someone loses a button, the item of clothing is already falling apart and so a replacement is purchased.


Back to my previous Brave New World reference, I don't think it's as much that the clothes now can't be repaired but that we, as a society, have developed the attitude that we shouldn't bother mending things when we can just buy a new, inexpensive replacement items.

I've lost buttons and had tears develop in the seams of several inexpensive pieces of clothing, something I've attributed to the lower standard of quality you refer to. However, by fixing the item, rather than simply throwing it away, I've prolonged the usefulness of the items. These will likely never be items that last a lifetime ... but they will last much longer than their first failure.

This is something I've been challenged with for other things too. How often to I replace or throw out items that only require minor repairs or a little elbow-grease to remain useful?

For example, my kid's rabbit ate through his laptop charger's power cord so my first reaction was to buy a new one. They were pretty pricey so I made him wait while I shopped around and he ended up not being able to use his laptop for quite a while as I vacillated on what the best option was. In the end, after fixing something else with a similar problem, I just fixed the cord and he was back up and running. But why wasn't my first reaction to fix it? Why was I so eager to spend money on a replacement with out even considering repair as an option?
